1. General

In this privacy policy, we (AWB Beratungen AG) explain in what way, to what extent and for what purposes we collect and process personal data on our website www.awb.ch.

AWB Beratungen AG is subject to Swiss data protection law, in particular the Swiss Federal Data Protection Act (DSG) and the associated ordinances (VDSG and VDSZ). Swiss data protection law is heavily influenced by EU law and AWB Beratungen AG, as a company outside the European Union or EEA, has to comply with the GDPR indirectly (due to contractual obligations) under certain circumstances. The EU recognizes that Swiss data protection law ensures adequate data protection.

Because the Swiss DPA is currently being revised and is expected to enter into force in 2022, the following statements already refer to the revised DPA.

3. PROCESSING OF PERSONAL DATA

Processing basically includes any handling of personal data, regardless of the means and procedures used, in particular also the modification, use, disclosure, storage, deletion, destruction of personal data.

Personal data is understood to be all information that relates to a specific or identifiable person. A person is identifiable if his or her identity can be determined on the basis of additional information.

If you provide us with personal data of other persons (e.g. data of work colleagues), please make sure that these persons are aware of this privacy policy and only share their personal data with us if you are allowed to do so and if this personal data is correct.

We primarily process personal data that we receive from our customers and other business partners in the course of our business relationship with them and other persons involved in it, or that we collect from their users in the course of operating our websites and other applications.

You can fill out a contact form on our website to get in touch with us. For this purpose, we process your name, the company name, the city or country of the company location, your e-mail address, telephone number and your request, which you can describe in the "Comments" field.

In this context, you can also choose whether you want us to inform you about our products by e-mail. If you do not wish to receive further information from AWB Beratungen AG, you can let us know. For this purpose, we refer you to our contact details in section 2 of this privacy policy. Each advertising e-mail also contains a link with which you can object to the further delivery of advertising e-mails.

To the extent permitted, we take certain data from publicly accessible sources (e.g. land registers, commercial registers, press, Internet, debt collection register), from authorities and other third parties.

4. CATEGORIES OF PERSONAL DATA

5. PURPOSE OF DATA PROCESSING

If you work for such a customer or business partner, your personal data may of course also be affected by our data processing in this capacity.

In addition, we process personal data of you and other persons, to the extent permitted and deemed appropriate, also for the following purposes, in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose:

Offering and further developing our offers, services, websites and other platforms on which we are present;

Communicating with third parties and processing their requests (e.g. applications);

Testing and optimizing procedures for needs analysis for the purpose of directly approaching customers as well as collecting personal data from publicly available sources for the purpose of customer acquisition;

Advertising and marketing (including the organization of events), insofar as you have not objected to the use of your data (if we send you advertising as an existing customer of ours, you can object to this at any time; we will then place you on a blocking list against further advertising mailings);

Assertion of legal claims and defense in connection with legal disputes and official proceedings;

Prevention and investigation of criminal offenses and other misconduct (e.g., conducting internal investigations, data analysis to combat fraud);

Guarantees of our operations, in particular IT, our websites, apps and other platforms;

Video surveillance to maintain housekeeping rights and other measures for IT, building and facility security and protection of our employees and other persons and assets belonging to or entrusted to us (such as access controls, visitor lists, network and mail scanners);

Purchase and sale of business units, companies or parts of companies and other transactions under company law and the associated transfer of personal data as well as measures for business management and insofar as necessary to comply with legal and regulatory obligations.

If you have given us consent to process your personal data for other specific purposes (for example, filling out the contact form), we process your personal data within the scope of and based on this consent, unless we have another legal basis and we require such a basis. Consent given can be revoked at any time, but this has no effect on data processing that has already taken place.

6. COOKIES, TRACKING AND OTHER TECHNOLOGIES IN CONNECTION WITH THE USE OF OUR WEBSITE

We deliberately use only technically necessary cookies and refrain from using analytics tools of any kind to systematically evaluate visitors to our website.

We also include visible and invisible image elements in our marketing e-mails in some cases and to the extent permitted. By retrieving these elements from our servers, we can determine whether and when you have opened the e-mail (person-related). This serves the purpose of quality assurance and improvement of our web services. You can block this in your email program; most are preset to do so.

By using our website, you agree to these techniques. If you do not want this, then you must set your browser accordingly. However, since these are exclusively technically necessary cookies, certain functionalities such as the contact form will no longer work.

Personal data transmitted via contact form will only be processed for the purpose stated therein, i.e., for example, for further information about our products or to order specific services.

7. DATA TRANSFER AND DATA TRANSMISSION ABROAD

In principle, we use your personal data only within our company. The data will be processed by employees of the Internal Sales Department, Technical Sales Department or other administrative departments of AWB Beratungen AG who are responsible for servicing your company or informing you or your company about the products or upcoming events. Only to the extent necessary, within the scope of our business activities and the purposes set forth in Section 3, and to the extent permitted and deemed appropriate, do we disclose personal data to companies we use in connection with data processing, in compliance with the requirements of data protection law.

In doing so, we contractually ensure that they take appropriate measures with regard to the security and protection of personal data and that they process the data only for the purposes for which we would be permitted to do so ourselves.

Our website is hosted by Metanet AG in Zurich via Megura AG in Baden, Switzerland.

The other service providers we use are located in the European Union (EU). In this context, we transfer personal data abroad. All of these countries have adequate data protection.

8. DURATION OF THE RETENTION OF PERSONAL DATA

We process and store your personal data as long as it is necessary for the fulfillment of our contractual and legal obligations or otherwise the purposes pursued with the processing, i.e. for example for the duration of the entire business relationship (from the initiation, processing to the termination of a contract) as well as beyond that in accordance with the statutory retention and documentation obligations. For example, we are required by law to retain data that we store for bookkeeping and accounting purposes for at least 10 years. In this context, it is possible that personal data will be retained for the time during which claims can be asserted against our company and to the extent that we are otherwise required to do so by law or legitimate business interests so require (e.g. for evidence and documentation purposes). As soon as your personal data is no longer required for the above-mentioned purposes, it will be deleted or anonymized as a matter of principle and to the extent possible.

9. Data Security

We take appropriate technical and organizational security precautions to protect your personal data from unauthorized access and misuse. Although we maintain modern protection mechanisms, complete protection against access by third parties cannot be guaranteed.

10. RIGHTS OF THE DATA SUBJECT

As a data subject, you have the right to request information from us about what data we process about you. You also have the right to have incorrect and unnecessary data corrected, deleted or destroyed.

Please note, however, that we reserve the right to enforce the restrictions provided for by law, for example if we are obliged to retain or process certain data, have an overriding interest in doing so (insofar as we are entitled to rely on this) or require it for the assertion of claims. If you incur costs, we will inform you in advance. We have already informed you about the possibility of revoking your consent in sections 3 and 5. Please note that the exercise of these rights may conflict with contractual agreements and may have consequences such as the premature termination of the contract or cost consequences. We will inform you in advance if this is not already contractually regulated.

The exercise of such rights usually requires that you clearly prove your identity, which is why we reserve the right to assure ourselves of the identity of the inquiring person and to request copies of meaningful documents (e.g. an official identity card). Every data subject also has the right to enforce his or her claims in court or to file a complaint with the competent data protection authority. The competent data protection authority in Switzerland is the Federal Data Protection and Information Commissioner (http://www.edoeb.admin.ch).

11. CHANGES

We may amend this Privacy Policy at any time without notice. The current version published on our website shall apply.
